Who should care for the children if both parents pass away early?
The death of parents is an unexpected blow, just as divorce was. The guardian who provides the best home with the least further disruption is the best. The other parent will get custody—absent an agreement to the contrary—but the real issue is which set of in-laws or whose best friend will get the kids if one of you dies first. That has to be agreed in advance so your kids aren’t left in limbo.
